What is the Parent Visa (Subclass 103)?

The Parent Visa (Subclass 103) is a permanent visa designed to allow parents of settled Australian citizens, permanent residents, or eligible New Zealand citizens to move to Australia and live indefinitely with their families.

Successful applicants gain permanent residency, enabling them to work, study, access Medicare, sponsor other eligible family members, and eventually apply for Australian citizenship if desired. It’s a pathway to long-term family reunification in Australia.

Timelines & Key Tests for Parent Visa 103

The Parent Visa (Subclass 103) offers permanent residency, but demand heavily outstrips available places, leading to very lengthy processing times, potentially many years. Ensuring your application is meticulously prepared from the start is crucial to avoid further delays.

Key eligibility hurdles include the “Balance of Family Test” (assessing family ties to Australia vs. overseas) and securing an “Assurance of Support.” Navigating these complex requirements and managing the long wait often benefits significantly from experienced legal guidance.

Sponsor Duties & Ensuring a Valid Application

For the Subclass 103 visa, the sponsoring child (or other eligible sponsor) must be settled in Australia and agree to provide support, housing, and financial help for the parent’s first two years. Any previous visa cancellations or refusals for the parent can also impact eligibility.

It’s vital that all information provided by both the sponsor and the parent is accurate and complete. Errors or omissions in demonstrating eligibility or fulfilling sponsorship obligations can jeopardise the entire application, underscoring the need for careful preparation.

Key Eligibility for the Subclass 103 Visa Applicant

Parents applying for the Subclass 103 visa must be sponsored by an eligible child (or other approved sponsor) and meet strict health and character requirements. Crucially, they cannot have already applied for or hold a Sponsored Parent (Temporary) Subclass 870 visa when applying for this permanent option.

Applicants must also satisfy the “Balance of Family Test,” ensuring at least half their children are eligible children in Australia, or more live here than in any other single country. Meeting all these criteria requires thorough documentation.

Frequently Asked Questions About Parent Visa (Subclass 103)

The Subclass 103 visa is a permanent visa that allows parents of settled Australian citizens, permanent residents, or eligible New Zealand citizens to move to and live in Australia indefinitely.

This visa grants permanent residency, allowing you to work and study in Australia, enrol in Medicare, sponsor eligible family members, travel for 5 years, and potentially apply for Australian citizenship.

The Balance of Family Test requires that at least half of your children (including step-children) are eligible children living permanently in Australia, or that more eligible children live in Australia than in any other single country.

Usually, an eligible child who is an adult, settled Australian citizen, permanent resident, or eligible New Zealand citizen sponsors their parent. In some cases, other relatives or community organisations may sponsor if the child is under 18.

An Assurance of Support (AoS) is a legal commitment by someone (usually the sponsor) to provide financial support to the visa applicant for their first two years in Australia, ensuring they don’t rely on government assistance.

Processing times are very lengthy, potentially up to 25-30 years or more, due to high demand and annual caps on the number of visas granted.

The visa application charge is paid in two instalments (currently from AUD $7,190 total). Other costs include health checks, police certificates, and potentially a bond for the Assurance of Support.

You can be in or outside Australia when applying. However, if you apply onshore, you generally won’t be granted a bridging visa to remain in Australia during the long processing period.

No, you cannot apply for a Parent Visa (Subclass 103) if you have already applied for or currently hold a Sponsored Parent (Temporary) (Subclass 870) visa.
