Understanding Citizenship by Resumption

Australian citizenship by resumption is a pathway for former Australian citizens to regain their citizenship status. It applies in specific circumstances, such as if you renounced your citizenship to acquire or retain another, or if you lost it automatically as an adult by gaining another citizenship before 4 April 2002.

Other grounds include loss in childhood due to a parent’s citizenship cessation or, historically, due to prolonged overseas residence. This process requires an application (Form 132) and evidence of past citizenship and how it ended. Unlike conferral, there’s usually no citizenship test or ceremony.

The Challenge of Evidencing Your Resumption Claim

To resume Australian citizenship, you must provide clear evidence of your former citizenship and how it ceased, such as historical documents or naturalisation certificates.

If your citizenship was lost under laws like Section 17 of the old Australian Nationality and Citizenship Act 1948 (Cth), the loss may be unknown until another application triggers a review. Getting expert legal help to provide accurate proof is crucial for a successful application.

Can You Resume Your Australian Citizenship?

Eligibility to resume Australian citizenship hinges on the specific reasons and laws under which it was previously lost. This often involves complex historical provisions, like automatic loss due to acquiring another citizenship before 4 April 2002 under old laws.

Proving how your citizenship ceased and meeting current identity and character requirements can be intricate. Determining if your circumstances align with an eligible pathway for resumption often requires careful legal assessment to ensure a valid application.

Character Assessments & Avoiding Resumption Refusal

Applicants aged 18 or over seeking to resume Australian citizenship must still satisfy the Department they are of “good character.” Past criminal convictions, court obligations, or even providing misleading information in previous dealings can impact this assessment.

Furthermore, if the Department finds you still hold Australian citizenship when assessing your resumption application, it will be deemed invalid. Ensuring your eligibility is correctly determined and all character aspects are properly addressed is vital to avoid refusal or unnecessary complications.

Frequently Asked Questions about Resuming Australian Citizenship

You can apply if you were previously an Australian citizen and ceased to be one under specific circumstances, such as acquiring another country’s citizenship as an adult before 4 April 2002, or renouncing your citizenship to retain/acquire another.

Eligibility depends on the reason your citizenship ceased. You must also satisfy the Department of your identity, be of good character (if 18+), and provide evidence of how your Australian citizenship ended.

If you were an adult and acquired another citizenship before 4 April 2002 (under former Section 17 of the Australian Nationality and Citizenship Act 1948 (Cth)), you may have automatically lost your Australian citizenship and could be eligible to resume it.

No, for applications to resume Australian citizenship, you generally do not need to attend an interview or sit the citizenship test. If approved, you become a citizen on the day of approval without a ceremony.

If, during the assessment of your resumption application, the Department determines you never actually lost your Australian citizenship, your resumption application will be treated as invalid, and the application fee is typically refunded.

You’ll need evidence like your Australian birth certificate (if applicable), previous Australian citizenship or naturalisation certificate, and documents from a foreign authority showing the date you became a citizen of another country, or documents related to your renunciation.

The application fee for Form 132 “Application to resume Australian citizenship” is AUD $240 (as of June 2025). There is no cost for a child under 16 years applying on the same form as a responsible parent.

If a child lost their Australian citizenship because their responsible parent lost theirs (e.g., under former Section 17 of the 1948 Act), the child may also be eligible to apply to resume their citizenship.
